REPEAL LI 2462

Background

In November 2022, the government of Ghana controversially and clandestinely introduced the Environmental Protection (Mining in Forest Reserves) Regulation 2022 (L.I. 2462) to provide statutory procedures for mining in forest reserves and remedial actions for mitigating the impacts of such actions. However, the law renders it unimportant.
  • Objectives in the 2012 Forest and Wildlife Policy
  • All previously stakeholder-agreed guidelines that limited the total area of forest estate that could be mined to 2%
  • The power of the forestry commission to refuse an entry permit,
  • The limitation of mining to the production of forest reserves and
  • The general illegality of mining in forest reserves.
While mining in forest reserves can have significant impacts such as deforestation, biodiversity loss, pollution, and climate change, this new regulation has placed no restrictions on mining in forest reserves.

Objectives

  • To produce a well-researched and comprehensive legal opinion on the new regulation on mining in forest reserves in Ghana .
  • Based on existing law-making processes and procedures, advocate for amending or a complete repeal of LI 2462.
